Podfeed Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Podfeed is a web application that allows users to convert various types of content—including PDFs, website URLs, YouTube videos, podcast episodes, audio files, video files, and raw text—into podcast-style audio using AI-powered script generation and text-to-speech technology. The Service also provides private RSS feed hosting for generated audio content.

3. User Accounts

• You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account and password.
• You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You may delete your account at any time through the account settings. Upon deletion, all your personal data and generated content will be permanently removed from our systems.

4. Subscription Plans and Payments

• Podfeed offers various subscription plans (Basic, Pro, Ultra) with different features and usage limits. By selecting a subscription plan, you agree to pay the applicable fees.
• Subscription fees are billed in advance on a recurring monthly basis.
• You may cancel your subscription at any time, but no refunds will be provided for any unused portion of the current billing period.
• Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's terms of service.

5. API Access

• Podfeed offers programmatic API access for developers. API usage is subject to the same terms as the web application.
• API keys are personal and must not be shared. You are responsible for all activity under your API key.
• We reserve the right to revoke API access for misuse or violation of these Terms.

6. Content and Copyright

• You retain all rights to the content you submit to the Service. By using the Service, you grant us a license to use, modify, and distribute the content solely for the purpose of providing the Service to you.
• You agree not to upload, share, or process any content that infringes on any copyright, trademark, patent, trade secret, or other proprietary rights of any party.
• We reserve the right to remove any content that violates these Terms or that we deem inappropriate.
• Uploaded source content (files, raw text) is deleted from our servers immediately after processing and is not retained.

7. Acceptable Use

You agree not to use the Service:

• For any unlawful purpose or to solicit the performance of any illegal activity.
• To harass, abuse, or harm another person or group.
• To impersonate or attempt to impersonate another user or person.
• In any way that violates any applicable federal, state, local, or international law or regulation.
• To generate content that is defamatory, obscene, or promotes violence or discrimination.
• To circumvent usage limits or abuse the Service in any way.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any errors, mistakes, or inaccuracies in the content generated by the Service.
• Any interruption or cessation of transmission to or from the Service.

9. Disclaimers

• The Service is provided on an "as is" and "as available" basis without any warranties, either express or implied.
• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
• We make no warranties regarding the accuracy, reliability, or quality of any content generated through the Service.
• AI-generated content may contain errors or inaccuracies. Users should review generated content before publishing or distribution.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Brazil. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of São Paulo, Brazil.
